Welcome to Kev The Bev! The terms "we", "us" and "our" refer to Kev The Bev, a trading name of VLTA LTD (company number 16561041, registered in England and Wales). Kev The Bev operates this store and website, including all related information, content, features, tools, products and services, in order to provide you, the customer, with a curated shopping experience (the "Services"). Kev The Bev is powered by Shopify, which enables us to provide the Services to you.

The terms and conditions below, together with any policies referenced in them (these "Terms of Service" or "Terms"), describe your rights and responsibilities when you use the Services.

Please read these Terms of Service carefully, as they include important information about your legal rights.

By visiting, interacting with or using our Services, you agree to be bound by these Terms of Service and our Privacy Policy (https://www.kevthebev.co.uk/policies/privacy-policy). If you do not agree to these Terms of Service or our Privacy Policy, you should not use or access our Services.

Nothing in these Terms affects your statutory rights as a consumer under UK law, including under the Consumer Rights Act 2015 and the Consumer Contracts (Information, Cancellation and Additional Charges) Regulations 2013.

By agreeing to these Terms of Service, you confirm that you are at least 18 years old.

To use the Services, including browsing our online store or buying any of the products we offer, you may be asked to provide certain information, such as your email address and billing, payment and shipping information. You confirm that all the information you provide is correct, current and complete, and that you have the right to provide it.

You are responsible for keeping your account login details secure and for all activity on your account. You may not transfer, sell, assign or license your account to any other person.

SECTION 2 - OUR PRODUCTS
We have made every effort to show our products accurately. However, colours and product appearance may look slightly different on your screen depending on your device and its settings.

Our products are printed to order. Product descriptions may change from time to time. We may discontinue any product at any time, and may limit the quantities of any product we offer to any person or region.

SECTION 3 - ORDERS
When you place an order, you are making an offer to buy. Your order is accepted when we email you to confirm it. We must receive your payment before your order is accepted. If we cannot accept, need to change, or have to cancel an order, we will contact you using the email address, billing address and/or phone number you provided, and will refund you in full for anything you have paid.

You have the right to cancel your order within 14 days of receiving it, as set out in our Refund Policy (https://www.kevthebev.co.uk/policies/refund-policy). Returns, refunds and faulty items are handled in line with that policy and your statutory rights.

You confirm that your purchases are for your own personal use and not for commercial resale.

SECTION 4 - PRICES AND BILLING
Prices, discounts and promotions may change without notice. The price you pay is the price shown at the time you place your order, as set out in your order confirmation email. Prices shown include VAT where applicable. Delivery charges are shown separately at checkout before you pay.

From time to time we may run promotions with their own terms. If the promotion terms conflict with these Terms, the promotion terms apply to that promotion.

You agree to provide current, complete and accurate payment and account information for all purchases, and to keep it up to date so that we can complete your orders and contact you if needed.

You confirm that the payment card details you provide are correct and complete, that you are authorised to use that card, and that you will pay for your order at the posted prices, including delivery charges.

SECTION 5 - SHIPPING AND DELIVERY
Delivery times are estimates, as set out in our Shipping Policy (https://www.kevthebev.co.uk/policies/shipping-policy). We are not responsible for delays caused by events outside our reasonable control. Your order becomes your responsibility (risk passes to you) once it has been delivered to you or to someone you have nominated to receive it.

SECTION 6 - INTELLECTUAL PROPERTY
Our Services, including all trademarks, brands, text, images, graphics, characters (including Kev the Bev), designs, product reviews, video and audio, and the way they are arranged, are owned by VLTA LTD or its licensors and are protected by copyright, trademark and other intellectual property laws.

These Terms allow you to use the Services for your own personal, non-commercial use only. You must not copy, distribute, modify, create derivative works from, publicly display, republish, download, store or transmit any of the material on the Services without our prior written consent. Nothing in these Terms grants you any licence or other right to any intellectual property of Kev The Bev, VLTA LTD, Shopify or any third party.

Kev The Bev's name, logos, characters, product names, designs and slogans are trademarks of VLTA LTD. You must not use them without our prior written permission. Shopify's name, logo, product and service names, designs and slogans are trademarks of Shopify. All other names, logos and trademarks on the Services belong to their respective owners.

SECTION 7 - OPTIONAL TOOLS
You may be given access to tools provided by third parties as part of the Services, which we do not monitor or control. Such tools are provided "as is" and "as available". Your use of them is at your own discretion, and you should make sure you are happy with the terms on which the relevant third party provides them.

We may add new features to the Services in future. Any new features are also covered by these Terms of Service.

SECTION 8 - THIRD-PARTY LINKS
The Services may contain links to websites run by third parties. We are not responsible for the content or accuracy of third-party websites, or for any products or services you buy from them. Please read their policies before you use them. Complaints or questions about third-party products or services should be sent to the third party.

SECTION 9 - RELATIONSHIP WITH SHOPIFY
Kev The Bev is powered by Shopify, which enables us to provide the Services to you. However, any sales and purchases you make in our store are made directly with Kev The Bev. By using the Services, you acknowledge and agree that Shopify is not responsible for any aspect of any sales between you and Kev The Bev, including any injury, damage, or loss resulting from purchased products and services. You hereby expressly release Shopify and its affiliates from all claims, damages, and liabilities arising from or related to your purchases and transactions with Kev The Bev.

SECTION 10 - PRIVACY POLICY
All personal information we collect through the Services is subject to our Privacy Policy (https://www.kevthebev.co.uk/policies/privacy-policy), and certain personal information may be subject to Shopify's Privacy Policy (https://www.shopify.com/legal/privacy). By using the Services, you acknowledge that you have read these privacy policies.

Because the Services are hosted by Shopify, Shopify collects and processes personal information about your access to and use of the Services in order to provide and improve them. Information you submit to the Services will be shared with Shopify and with third parties that may be located in other countries. Please see our Privacy Policy for more details.

SECTION 11 - FEEDBACK
If you send us ideas, suggestions, feedback, reviews or other content ("Feedback"), you give us a free, worldwide, permanent licence to use, reproduce, modify, publish and display that Feedback for any purpose, including to promote the Services.

You confirm that you own or have the right to share any Feedback you send, that it is accurate, and that it does not infringe anyone else's rights or contain anything unlawful, abusive, obscene or harmful (including viruses). We are not obliged to keep Feedback confidential, pay for it, or respond to it, and we may remove any Feedback we consider unlawful, offensive or in breach of these Terms.

SECTION 12 - ERRORS, INACCURACIES AND OMISSIONS
Occasionally the Services may contain errors, for example in product descriptions, pricing, promotions, delivery charges or delivery times. We may correct any errors at any time. If an error affects an order you have placed (for example, an obviously incorrect price), we will contact you before continuing, and you may cancel the order for a full refund.

SECTION 13 - PROHIBITED USES
You may use the Services for lawful purposes only. You must not use the Services: (a) for any unlawful or malicious purpose; (b) to break any law or regulation; (c) to infringe our intellectual property rights or anyone else's; (d) to harass, abuse, insult, defame or intimidate anyone; (e) to send false or misleading information; (f) to send spam, junk mail or other unsolicited advertising; (g) to impersonate any person or organisation; or (h) in any way that restricts others' use of the Services, or which may harm Kev The Bev, Shopify or other users.

You also agree not to: (a) upload or send viruses or other malicious code; (b) copy, resell or exploit any part of the Services; (c) collect or track other people's personal information; (d) use any robots, scrapers, AI agents or other automated tools to access the Services, except as allowed in Section 14; or (e) bypass or interfere with any security features of the Services. We may suspend or close your account if you break these Terms.

SECTION 14 - AGENTS
14.1 This section applies if you use, allow or cause an Agent to access, use or interact with the Services. "Agent" means any software or service that takes autonomous or semi-autonomous action on behalf of, or at the instruction of, any person or organisation, without direct supervision.
14.2 No Agent may access, use or interact with the Services unless, at all times, it identifies itself and operates in line with section 14.4. No Agent may access the Services if we have asked it not to.
14.3 We may limit, including by technical measures, whether and how any Agent accesses, uses and interacts with the Services.
14.4 Agents must: (i) in all HTTP/HTTPS requests, identify that the request is from an Agent and give the Agent's name in the request's user agent string as "Agent/[agent name]"; (ii) not hide that any access or interaction comes from an Agent, for example by mimicking human behaviour or completing or getting around CAPTCHAs; (iii) answer truthfully any question about whether interactions come from a human or a computer; and (iv) not get around any measure intended to block, limit or control how Agents use the Services.

SECTION 15 - TERMINATION
We may end these Terms or your access to the Services (or any part of them) at any time. You will remain liable for any amounts due up to the date of termination. This does not affect any order we have already accepted, which we will still fulfil or refund.

The following sections continue to apply after termination: Intellectual Property, Feedback, Termination, Disclaimer of Warranties, Limitation of Liability, Indemnification, Severability, Waiver and Entire Agreement, Assignment, Governing Law, Privacy Policy, and any other provisions that by their nature should continue.

SECTION 16 - DISCLAIMER OF WARRANTIES
General information on the Services is provided for information only. Apart from the promises we make in these Terms and your rights under consumer law, the Services are provided on an "as is" and "as available" basis, and we do not guarantee that your use of the Services will be uninterrupted, timely, secure or error-free.

Nothing in these Terms limits your legal rights as a consumer. Under the Consumer Rights Act 2015, the goods we sell must be as described, fit for purpose and of satisfactory quality.

SECTION 17 - LIMITATION OF LIABILITY
We are responsible for loss or damage you suffer that is a foreseeable result of us breaking these Terms or failing to use reasonable care and skill. We are not responsible for loss or damage that is not foreseeable, or for any business losses, as our products are for personal use only.

Nothing in these Terms excludes or limits our liability for death or personal injury caused by our negligence, for fraud or fraudulent misrepresentation, or for anything else that cannot be excluded or limited by law, including your rights under the Consumer Rights Act 2015.

SECTION 18 - INDEMNIFICATION
You agree to compensate Kev The Bev, VLTA LTD, Shopify and our affiliates, officers, employees, agents and service providers for any losses, damages or claims (including reasonable legal costs) brought by a third party that arise from (1) your breach of these Terms, (2) your breach of any law or of anyone else's rights, or (3) your misuse of the Services.

SECTION 19 - SEVERABILITY
If any part of these Terms is found to be unlawful, void or unenforceable, that part will be enforced to the fullest extent the law allows, and the rest of these Terms will continue to apply.

SECTION 20 - WAIVER; ENTIRE AGREEMENT
If we do not enforce any right or provision in these Terms, that does not mean we have given up that right.

These Terms of Service, together with any policies posted by us on this site, form the entire agreement between you and us about your use of the Services, and replace any earlier agreements or versions of these Terms.

SECTION 21 - ASSIGNMENT
You may not transfer your rights or obligations under these Terms without our prior written consent. We may transfer our rights and obligations under these Terms to another organisation, and will tell you if this happens. It will not affect your rights under these Terms.

SECTION 22 - GOVERNING LAW
These Terms are governed by the law of England and Wales. You can bring legal proceedings in respect of these Terms in the courts of England and Wales. If you live in Scotland or Northern Ireland, you can also bring proceedings in the courts of your home country.

The headings in these Terms are for convenience only and do not affect their meaning.

You can read the latest version of these Terms of Service on this page at any time. We may update these Terms from time to time by posting changes on our website. The Terms that apply to your order are the ones in force when you placed it. We will tell you about any significant changes as required by law.
